What would the prosecutor have to prove to convict me of the Use or Possession of Drug Paraphernalia?
To convict you of the use or possession of drug paraphernalia, the prosecutor would have to prove that you used or had drug paraphernalia in your possession and that you knew of its presence. The definition of drug paraphernalia is very broad. It not only includes obvious paraphernalia like roach clips and bongs, but also things like scales and kits used in cultivating plants from which drugs are made.
